YALLA FAST Privacy Policy

Dear user, BEN MUSAWA COMPANY (“we,” “our,” or “YALLA FAST”) is committed to protecting the privacy of all visitors to our YALLA FAST online application and all visitors who access our Services through any mobile application (together, the “Website”). So please read our Privacy Policy, which explains how we use and protect your information.

By accessing or using the Application and/or Services, you agree that you have read, understood, and agree to all terms and conditions and privacy policy the collection, storage, use and disclosure of your personal information as described in our Privacy Policy and Terms of Use.

This privacy policy applies only to our application and Website, and does not extend to the websites of any other companies or organizations (including restaurants) to which we link, and specifically addresses our obligations in respect of applicable laws in the Kingdom of Saudi Arabia.

As a food delivery search engine, YALLA FAST connects prospective food delivery service buyers with food delivery service providers & third parties, such as restaurants.  If we ever need additional personal information for a specific reason, we will tell you and ask for your permission. Also, to the extent that YALLA FAST has links to other websites (like 3rd party delivery services or restaurants), please note that we do not own, operate, or control them, and they have their own controlling privacy policies that you should review.

For food delivery service buyers, this policy would apply to prospective buyers when you sign up for an account or download our mobile app;

For 3rd party restaurant service vendors, it would apply when you create a free listing for your partner restaurant(s); create an account with us; and/or when you connect with a digital marketing expert or submit a query.

Despite these provisions, this site is not intended for use by minors or those without legal capacity in accordance with the Saudi system. Therefore, we ask their legal guardians to take the necessary caution and care.

 

 

  1. Collecting, Using, and Sharing Your Personal Information.

 

1.1. Identifiers. When you create an Account, complete your Account profile, place an order, sign up for a mailing list, or otherwise communicate or interact with us (whether or not through an Account), we collect identifiers such as your name, address, phone number, and email address. We may also collect identifiers like your name or email address from other people or businesses. For example, we may receive identifiers:

  • Social media data (if you choose to link your YALLA FAST account with a social media account, YALLA FAST may collect personal information such as name, age, gender, photograph, and other personal information relating to your social media account)
  •  From other YALLA FAST users who refer you to our Services or use our group order future.
  •  From organizations, you are part of, such as your employer or university that use our enterprise services. Identifiers can also include numbers assigned to you like your IP address or a unique YALLA FAST account number and information about your device and its software like your browser type, device type/model/manufacturer, operating system, and other similar information. These identifiers are collected or created automatically when you use the Site.
  • For the purposes of the previous clauses, you acknowledge and acknowledge that all of your information entered is correct and up-to-date, and that you bear legal responsibility for any false information that may cause loss to us or any of our services.

We may use this information to:

  • Create and manage your Account.
  •  Facilitate order and delivery services.
  •  Communicate with you directly about the Services, including your orders, as well as answer any questions, issues, or concerns you or other users may have.
  •  Analyze use of and improve the Site and our Services.
  •  Detect and prevent fraud, abuse, or other harmful activities, conduct security investigations and risk assessments, and improve and enforce our security measures.
  •  Send you marketing communications.

We may share this information with ad networks and other advertising partners for the purpose of cross-context behavioral advertising. For campus users only, we may provide identifiers to select food service providers that operate restaurants and other food ordering and delivery services on your campus so that they can communicate directly with you and send you personalized communications and marketing. We may also disclose identifiers to our service providers, or for other lawful purposes, as described in detail in Section 1.10below.

YALLA FAST retains identifiers for as long as you have an account with YALLA FAST, and for such additional period as YALLA FAST determines is necessary to comply with its legal obligations and defend against legal claims.

1.2. Payment Card Information. You may pay for YALLA FAST products or services using your payment card and in such cases we will collect your personal data connected to your payment card. We use this personal data in order to process your payment and to prevent fraudulent transactions. We do this on the basis of your consent to process this information.

We do not sell payment information to third parties or share it with third parties for cross-context behavioral advertising. We also do not share this information with third parties for business or commercial purposes, though we may disclose it to our service providers, or for other lawful purposes, as described in detail in Section 1.10 below.

YALLA FAST retains payment information for as long as you have an account with YALLA FAST, and for such additional period as YALLA FAST determines is necessary to comply with its legal obligations and defend against legal claims.

YALLA FAST disclaims any responsibility for any violation of the provisions of the Saudi system in the Kingdom or the ethics and provisions. It has the right to refuse to register any person or service provider whose activity does not comply with the laws and regulations of the Kingdom or the provisions of this policy. We have the right to close any account permanently or temporarily and without referring to you if it becomes clear that We know that he violated the terms, conditions and policies of the site and did not comply with their provisions

 

1.3. Commercial Information. Whenever you make purchases on the Site, we collect commercial information about you, such as your ordering history, purchasing tendencies, and rewards program progress. This information may be used to.

  • Facilitate order and delivery services.
  •  Analyze use of and improve the Site and our Services.
  •  Detect and prevent fraud, abuse, or other harmful activities, conduct security investigations and risk assessments, and improve and enforce our security measures.
  •  Personalize your YALLA FAST experience, including which Merchants and items we recommend to you and any ads you may see from us.
  • Manage your rewards program progress.

We may share commercial information with ad networks and other advertising partners for the purpose of cross-context behavioral advertising. Please see Section 2.1 below for additional information about your choices. We may also disclose commercial information to our service providers, or for other lawful purposes, as described in detail in Section 1.10below. YALLA FAST retains commercial information for as long as you have an account with YALLA FAST, and for such additional period as YALLA FAST determines is necessary to comply with its legal obligations and defend against legal claims.

1.4. Internet Usage Information. When you use the Site, we collect internet usage information from you automatically, such as information about how you interact with the Site, your browsing history, and your search history. Depending on your device and/or browser settings, this information can include the site from which you came to our site. The site to which you are going when you leave our site, the pages you visit on the Site, the links you click, whether you open our emails or click the links we send, whether you access the Site from multiple devices, page scrolling, and where you click or move your mouse on our website.

We use this information to:

  • Analyze use of and improve the Site and our Services.
  •  Detect and prevent fraud, abuse, or other harmful activities, conduct security investigations and risk assessments, and improve and enforce our security measures.
  •  Personalize your YALLA FAST experience, including which Merchants and items we recommend to you and any ads you may see from us.
  •  Evaluate the success of our advertising and marketing campaigns.
  • Send you marketing communications.

We may collect internet usage information through a variety of tracking technologies, including cookies, web beacons (also known as pixels), embedded scripts, mobile SDKs, location-identifying technologies, and similar technology (collectively, “tracking technologies”), and we may use third-party partners or service providers to assist with this effort, such as Google and. Information we collect automatically about you or your device may be combined with other personal information we collect directly, and our third-party partners may combine this information with information collected from other devices, websites, or apps.

1.5. Location Information. We may collect additional information from your location when you opt in for us to do so.  If you enable location services for the Services we may collect your regional location data periodically as you use or leave open the Services. We may also collect your location information from your IP address or zip code.

We may also use location data internally or in conjunction with our third party service providers to customize your experience and provide offers that may be relevant to you. We use location information to:

  • Facilitate order and delivery Services.
  •  Analyze use of and improve the Site and our Services.
  •  Detect and prevent fraud, abuse, or other harmful activities, conduct security investigations and risk assessments, and improve and enforce our security measures.
  •  Personalize your YALLA FAST experience, including which Merchants and items we recommend to you.

We may use the Google Maps API to gather geolocation data. Google uses various technologies to determine your location, including IP address, GPS and other sensors that may, for example, provide Google with information on nearby devices, WiFi access points and cell towers (see the Google privacy policy and the Google Maps terms of service to learn more).

We do not sell geolocation data to third parties or share it with third parties for cross-context behavioral advertising. We also do not share this information with third parties for business or commercial purposes, though we may disclose it to our service providers, or for other lawful purposes, as described in detail in Section 1.10below.

YALLA FAST retains geolocation data for as long as you have an account with YALLA FAST, and for such additional period as YALLA FAST determines is necessary to comply with its legal obligations and defend against legal claims.

1.6. Recorded Communications. We may record calls for training, quality and research purposes. All recordings will be treated as confidential. We do not sell audio and video information to third parties or share it with third parties for cross-context behavioral advertising. We also do not disclose this information to third parties for business or commercial purposes, though we may disclose it to our service providers, or for other lawful purposes, as described in greater detail in Section 1.1 below.

YALLA FAST retains audio and video information for as long as you have an account with YALLA FAST, and for such additional period as YALLA FAST determines is necessary to comply with its legal obligations and defend against legal claims.

1.7. Education Information. If you are a student at a school that participates in our Services, we may receive a student identification or billing number or campus dining card information from your school, in order to enable you to use our campus dining Services.

We may disclose education information to select food providers that operate restaurants and other food ordering and delivery services on your campus so that they can communicate directly with you and send you personalized communications and marketing. We may also disclose this information to our service providers, or for other lawful purposes, as described in detail in Section 1.10below.

YALLA FAST retains education information for as long as you have an account with YALLA FAST , and for such additional period as YALLA FAST determines is necessary to comply with its legal obligations and defend against legal claims.

1.8. Inferences. When you use our Services, we may make inferences about your preferences, such as what kinds of restaurants you like to order food from and what dishes you might like. These inferences help us to personalize your YALLA FAST experience, including which Merchants and items we recommend to you and any ads you may see from us.

We do not sell this information to third parties or share it with third parties for cross-context behavioral advertising. We also do not share this information with third parties for business or commercial purposes, though we may disclose it to our service providers, or for other lawful purposes, as described in detail in Section 1.10below.

YALLA FAST retains inferences about you for as long as you have an account with YALLA FAST, and for such additional period as YALLA FAST determines is necessary to comply with its legal obligations and defend against legal claims.

1.9. Communications Content. We maintain communications resulting from your interactions with us or with Delivery Partners, such as email, mail, and chat messages and comments and opinions you express when responding to surveys. We use these communications to

  • Communicate with you directly about the Services, including your orders, as well as answer any questions, issues, or concerns you or other users may have.
  •  Analyze use of and improve the Site and our Services.
  •  Detect and prevent fraud, abuse, or other harmful activities, conduct security investigations and risk assessments, and improve and enforce our security measures.

We do not sell communications content to third parties or share it with third parties for cross-context behavioral advertising. We also do not share this information with third parties for business or commercial purposes, though we may disclose it to our service providers, or for other lawful purposes, as described in detail in Section 1.10below.

YALLA FAST retains communications content for as long as you have an account with YALLA FAST, and for such additional period as YALLA FAST determines is necessary to comply with its legal obligations and defend against legal claims.

    1. Other Circumstances Under Which We Might Use or Disclose Your Data.

In addition to the above, YALLA FAST may need to use or disclose your personal information for:

  • providing our Services, including by providing information to Merchants, delivery providers, payment processors, and other service providers that we rely on to process and fulfill orders or other service providers that help us keep the Site and our Services running smoothly;
  • completing your requests, including by providing information to other YALLA FAST users when you use our group order feature or to Merchants who you direct us to provide information to;
  • allowing you to use our enterprise services, including by providing information to your university or employer so that you can use its enterprise account;
  • enabling your participation in Merchant reward programs, including by providing your information toe Merchants as needed to track points and otherwise facilitate your participation in the reward program;
  • Comply with legal and regulatory requirements and procedures, including corporate reporting obligations, subpoenas, or law enforcement requests from government agencies in accordance with the regulations in force in the Kingdom of Saudi Arabia.
  • enforcing our rights, including to (a) investigate, prevent, and/or mitigate violations of our Terms of Use, (b) detect, suppress, or prevent fraud or reduce credit risk and collect debts owed to us, (c) exercise or protect the rights, property, or personal safety of YALLA FAST, our visitors, or others, and/or (d) enforce our agreements with third parties and business partners.

We may also disclose your personal information to:

  • Other companies owned or controlled by BEN MUSAWA COMPANY . and other companies owned by or under common ownership as BEN MUSAWA COMPANY . which also includes our subsidiaries (i.e., any organization we own or control), or our ultimate holding company (i.e., any organization that owns or controls us). Moreover, any subsidiaries it owns, for operational or business purposes or as otherwise described in this Privacy Policy.
  • A third party during negotiation of, in connection with, or as an asset in a corporate business transaction, such as a merger, acquisition, joint venture, or financing or sale of all or a portion of company assets, or in the event of insolvency, bankruptcy, or receivership.

Finally, we may use or disclose personal information for a specific purpose not contemplated by this Privacy Policy. In such an event, we will specifically disclose that use to you and, when necessary, obtain your consent

  1. Disclosure Of Your Information

The information you provide to us will be transferred to and stored on our servers.

Third parties process information such as credit card payments and provide support services related to payments for us. Third parties also help us analyse the information we collect so that we can administer, support, improve and develop our business and services to you. In addition, we may need to provide your information to any restaurants ("Partner Restaurants") that you have placed your order with. By submitting your personal data, you agree to this transfer, storing or processing. YALLA FAST will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy policy.

You agree that we may allow carefully selected third parties, including marketing and advertising companies, our affiliates and associates, to contact you occasionally about services that may be of interest to you. They may contact you by telephone, SMS as well as by e-mail. If you change your mind about being contacted by these companies in the future, please let us know by using the contact details set out below and/or by amending your profile accordingly. We may also share your personal data with marketing companies who help us analyse the personal data we collect so that we can administer, support, improve and develop our business and services to you.

If our business enters into a joint venture with, purchases or is sold to or merged with another business entity, your information may be disclosed or transferred to the target company, our new business partners or owners or their advisors.

We may use the information that you provide to us if we are under a duty to disclose or share your information in order to comply with (and/or where we believe we are under a duty to comply with) any legal obligation, or in order to enforce our Website Terms and any other agreement, or to protect the rights of YALLA FAST, Partner Restaurants or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and prevention.

We may share or need to transfer to or store data we have received from you with affiliates and subsidiaries of YALLA FAST which are located in countries other than the Kingdom of Saudi Arabia. The laws governing data protection in these countries or jurisdictions may differ from the laws in the Kingdom of Saudi Arabia. We will comply with the laws applicable in the Kingdom and take all steps reasonably necessary to ensure that similar and/or comparable standards for data protection are maintained by any Affiliates that are recipients of your information. By your voluntary submission of information to us, you are consenting to the disclosure, transfer and use of your personal information outside of the Kingdom of Saudi Arabia for the purposes described in this privacy policy.

Your personal information will also be transferred to other third party organizations in certain scenarios (subject to applicable law):

  • If we sell, purchase or transfer any part or all of our business or assets (including in bankruptcy), or in the event of another corporate change, in which case we may disclose your Information to the prospective seller, buyer or administrator of such business or assets including for pre-transaction review under suitable terms as to confidentiality;
  • If we are reorganized or sold, information may be transferred to a buyer who can continue to provide services to you;
  • If we are defending a legal claim, our property, our website/s or other users, Information may be transferred as required in connection with defending such claim.
  • If there is an emergency which requires us to share your data or for the health and safety of our Site/s's users or the general public.
  • We also may share aggregate or anonymous information about you (which does not contain any personal information) to develop content and services and further improve your digital markets experience.
  1. Security

  1. Cookies

Cookies give users a special ID, which are small text files that are stored in the memory of a user’s computer, mobile, e-reader, tablet or other device used to access the YALLA FAST Applications (“Device”). YALLA FAST employs cookies to recognize you and your access privileges for certain locations on the Devices as well as to track site usage. Subscribers who do not accept cookies from the Devices cannot access many areas of the Devices. We use both “session ID cookies” and “persistent cookies.” Session ID cookies are used to store information while a user is logged into the Devices and expire when the user closes his/her browser. Persistent cookies are used to make tasks like logging into the Devices easier for returning users by remembering a user’s login information. Persistent cookies stay on a user’s hard drive from one session to the next. “Flash cookies,” known as local shared objects, are data files placed on a Device via the Adobe Flash plug-in that may be built-in to or downloaded by you to your Device to personalize your visit.
